Ethics of Computer Forensics and Electronic Discovery Data

Webinar approx. 60 min. (1 Hr. CLE) No Separate PowerPoint
Inherent in large eDiscovery cases is the over-riding tension regarding the immense amount of data to process and review to which the competence of the attorney becomes an ethical obligation. The burden of the conditions surrounding what can be presented and supported in court falls upon counsel and is greater  now than ever before.

Attorney ethical liability relies on ensuring proper eDiscovery, with resulting consequences including disqualification, disciplinary action and sanctions due to failure to comply with security, client data and confidentiality. This course addresses the ethical requirements of data in computer forensics and eDiscovery. Hot topics will include current case law regarding the issues below.

  1.     The duty of data vs. preservation: The data to care about in the needle vs. the haystack.
  2.     How data impacts attorney ethical liability: What to really look at in forensics vs. e-discovery?
  3.     Ethical challenges of document review: You can look at everything, but why?
  4.     Ethical implications of production: So many choices, but what is best?
  5.     New internet technologies & attendant ethics issues: Blogs, social networks & the internet.
  6.     International discovery: Privacy and data protection.
