eDiscovery: Social Media and Cell Phone Evidence

Social networking and cell phone usage have become a huge part of our culture. We now have the ability to share our latest successes, failures and personal opinions instantly. Many individuals think that an intimate circle of friends will only view their postings, comments, images and text messages.

However, status updates, chat sessions, and text messages are some of the items that can be recovered from the users computers and cell phones. It is often not necessary to go to the service provider to find the private contents of social networking sites or text messages.

This presentation will discuss the types of evidence that can be recovered, what steps are necessary to recover this data, and the types of cases where they can be useful. A demonstration of cell phone data extraction will also be provided.

John Mallery is one of the pioneers in the computer forensics industry with fourteen years of experience . He has testified in Federal Court regarding digital evidence in both criminal and civil litigation. He is a popular speaker having provided more than 200 CPE and CLE presentations.

He draws on his experiences working at a private investigation firm founded by a former F.B.I. director, as well as managing a national computer forensics practice. He has the ability to explain technical concepts in simple terms and how those concepts apply to the practice of law.
