Social Media: Internal Investigations - Privacy, Ethics and Litigation Concerns

When conducting an internal investigation, social media sites offer much allure for the quick gathering of candid information.  However, inside and outside counsel conducting internal investigations should curb their impulse to freely access and use social media accounts.  Although the business world and legal profession are still catching up with recent technology, change is quickly being promulgated in the form of cases, statutes, professional rules and website policies that limit such access and may impact the use of such information in any later litigation.

William "Bill" Michael is a partner and Co-Chair of the White Collar Defense & Compliance practice group at Mayer Brown. He is an experienced trial attorney with more than 100 jury trials in state and federal courts focusing on complex federal white collar and regulatory defense, civil and criminal health care fraud, anti-trust and complex internal investigations.

He represents both individuals and corporations in these matters, including: Internal Investigations, Criminal Antitrust, Health Care, Securities Fraud, Criminal Tax, Qui Tams, Money Laundering, Conspiracy, Environmental and Foreign Corrupt Practices Act. Before entering private practice, Mr. Michael had a distinguished career in public service, including 10 years with the US Department of Justice (DOJ) as an Assistant US Attorney in the Southern District of Florida and the District of MN. 

Laura Hammargren is an associate in Mayer Brown’s Litigation & Dispute Resolution practice group. In her investigations practice, she represents corporations and individuals in internal investigations or who are under investigation by federal and state authorities, to include assisting several corporate clients to respond to DOJ investigations in various districts around the country. 

The areas in which she has recent experience include health care fraud, securities fraud, Foreign Corrupt Practices Act (FCPA) and False Claims Act (FCA) violations. She has experience in a variety of civil and criminal litigation matters before various courts and tribunals, concentrating in highly-regulated including securities, healthcare, energy, financial institutions, and data privacy.
