The European Commission's 2012 proposal for a new General Data Protection Regulation represents the most significant change in EU data protection laws since the EU Directive 95/46 of 1995.

The proposed Regulation, with its few thousands of tabled amendments, is currently being debated in the EU Parliament and in the Council of Europe and is expected to be voted into law before the end of 2014. This new Regulation will considerably impact cross-border e-discovery in the EU, especially as far as the obligations of vendors as "processors" of personal data is concerned.
